Sr. Manager, Sr. Counsel- Privacy and Data Protection

Overview:

Capital One is transforming financial services by investing in data-driven products, technology, and digital experiences. To support this growth, we are seeking an experienced attorney to join our privacy legal team. We thrive in an open and collaborative environment where diverse perspectives fuel innovation and drive superior results.

About the role:

This role provides an opportunity to work at a leading financial institution with a long history of using data and technology to build innovative financial products. You will join an experienced team of legal subject-matter experts focusing on privacy and will advise on a wide range of privacy laws. Our team supports many of the most important and strategic initiatives at the company and works with all lines of business across Capital One’s global footprint.

You will collaborate with other legal, compliance, risk, and business partners at the company, with a particular focus on supporting new initiatives, advising on sector-specific privacy laws and navigating transactional and contract privacy issues.  You will spot issues, solve problems, and influence our partners to mitigate legal and regulatory risk in a challenging and rapidly evolving space.

Key responsibilities include:

  • Identifying privacy issues in a complex, highly regulated environment

  • Communicating privacy legal requirements and risks effectively to legal, business, compliance, and risk partners

  • Supporting partners in building technical and organizational privacy controls, drafting privacy notices and disclosures, developing policies and procedures, preparing internal documentation, and enhancing privacy operations and strategy

  • Advising on contract privacy language and providing transactional privacy advice in the context of mergers, acquisitions, and strategic partnerships

  • Collaborating with outside counsel, developing written legal guidance and presentations, monitoring legal developments and industry trends, and contributing to the legal privacy team’s existing knowledge and resources

  • Tracking and advising on privacy legislation and new privacy laws

Who you are:

You are a strategic thinker and a pragmatic problem-solver who can synthesize complex legal information and communicate effectively to partners across departments and job-levels.  You have an ownership mentality but also enjoy being part of a team.  You are serious about your work but don’t take yourself too seriously.  You enter uncharted territory with enthusiasm, curiosity, humility, and good humor.  You have strong judgment and experience advising on issues with nuanced business, legal, and compliance considerations.

Basic Qualifications:

  • Juris Doctor from an accredited law school

  • Active member in good standing of at least one state bar

  • At least 4 years of experience in privacy law, regulatory counseling, or consumer financial services at a law firm, in-house legal department, or government agency

Preferred Qualifications:

  • Strong knowledge of privacy laws, regulations, and principles in the United States and internationally, including sector-specific laws such as GLBA, HIPAA, and COPPA and comprehensive laws such as CCPA and GDPR

  • Substantive experience building practical, risk-based privacy compliance solutions and advising on policies and procedures at large, multinational companies

  • Experience helping partners to prepare documentation such as privacy notices, records of processing activities, transfer risk assessments, data protection impact assessments, and data processing agreements

  • Proficiency in negotiating privacy contract language, conducting privacy due diligence, and advising on mergers, acquisitions, and strategic partnerships

  • Demonstrated ability to communicate complex legal issues to a variety of audiences, interact with senior leadership, and influence business partners
